Sahwan Law practitioner summary

MoJ Resolution No. 35 of 2020 on the Regulation of Procedures for Small-Claims Disputes governs the filing, administration, hearing, and determination of small-claims cases before the Small Civil and Commercial Court. Issued by the Minister of Justice, Islamic Affairs and Endowments, it implements the small-claims regime under the Civil and Commercial Procedures Law (DL 12/1971, as amended by Law 18/2018). Small-claims disputes (defined by reference to a statutory monetary threshold) are managed through a streamlined track designed for speed and low cost. Main provisions cover: the scope of application to small-claims matters; electronic and paper filing of the statement of claim with prescribed party, claim, and contact particulars; fee payment and case registration; service and summons; expedited exchange of memoranda and documents on short deadlines fixed by the court; single-judge hearings; rules on expert evidence in small-claims cases; judgment, cost orders, and the limited scope of appeal permitted. The Regulation encourages electronic submissions, settlement, and judicial case management to reduce backlog. It is the small-claims counterpart of MoJ Resolution No. 30 of 2020 (commercial cases). Pre-cutoff, it was amended by MoJ Resolution No. 24 of 2023 (2 March 2023), which updated timelines and electronic-filing mechanics. Current as of 2026-04-20, reflecting the pre-1 September 2025 cutoff state.
